3.3.2 Vacancy more than 12 months before the next triennial election
- If a vacancy occurs more than 12 months before the next local government triennial election, it must be filled by an election (by-election) under section 117(1) of the Local Electoral Act For further information see Section 17: Elections.
- The election must be held not later than 89 days after the date the electoral officer receives notice of the vacancy from the council’s chief executive (section 120).
- If no-one is nominated for a by-election, the Governing Body or local board may (by resolution) fill the vacancy by appointment (section 117A).
