4.9.5 Official information held by the mayor’s office

 

  1. The mayor’s office is part of the council and therefore the information it holds is subject to LGOIMA [1]. This includes information of a political or personal nature to the mayor [2]. Such information may be able to be withheld to protect privacy, an obligation of confidence, or free and frank expression of opinions [3]. A question may arise whether information is actually held by the office or staff member as an agent of the mayor personally [4].

  2. The office should ensure there are appropriate protocols in place so that local government official information can be identified and disclosed, consistent with council LGOIMA policies. These arrangements are operational, and so need to be made in coordination with the chief executive.
