3.3.2 Vacancy more than 12 months before the next triennial election

  1. If a vacancy occurs more than 12 months before the next local government triennial election, it must be filled by an election (by-election) under section 117(1) of the Local Electoral Act For further information see Section 17: Elections.
  2. The election must be held not later than 89 days after the date the electoral officer receives notice of the vacancy from the council’s chief executive (section 120).
  3. If no-one is nominated for a by-election, the Governing Body or local board may (by resolution) fill the vacancy by appointment (section 117A).
